(1) The post of a nominated member of the Council shall be deemed to be vacant in the following cases:-
(a) if he tenders his resignation in writing to the Chairman,
(b) If he is a non-Nepali citizen or if he obtains a permanent residence permit from a foreign country,
(c) If he reaches the age of seventy years, but in the case of a member as per clause (d) of sub-section (2) of section 3, the age limit as per this section shall not be applicable.
(d) if a candidate for any public accountability post,
(e) Convicted of corruption, extortion, sexual abuse, human trafficking and trafficking, sale and distribution and exportation or importation of narcotics, money laundering, passport misuse, kidnapping related offences, organized crime or criminal offense of moral turpitude or any other criminal offence. For an offense punishable with imprisonment for one year or more, when such judgment is final,
(f) If removed from office under sub-section (2) of section 7,
(g) In case of consecutive absence from three meetings of the Council without notice,
(h) If it is proved that he has absconded while representing the nation and returned later,
(i) In case of his death.
(2) According to sub-section (2) of section 3, if the term of office of the nominated members in the council is not completed due to any reason, the position will be vacant for the remaining period, they will be nominated by the same process by which the said member was nominated.
